The U.S. The Supreme Court’s jurisprudence concerns & constitutionality of courts’ exercise of personal jurisdiction over defendants, the Court has addressed personal jurisdiction over plaintiffs in one important decision. “The Due Process Clause of the Fourteenth Amendment limits the power of a state court to render a valid personal judgment against a nonresident Defendant. [ See Kulko v. Superior Court, 436 U.S. 84, 91 (1978)]; “A judgment rendered in violation of due process is void in the rendering State and is not entitled to full faith and credit elsewhere.” The Fourteenth Amendment’s Due Process Clause also requires that a defendant receive adequate notice that a lawsuit has been brought against him and having the opportunity to respond free and clear of fraud and duress is also a prerequisite. “An elementary and fundamental requirement of due process in any proceeding which is to be accorded finality is noticed reasonably calculated, under all the circumstances, to apprise interested parties of the pendency of the action and afford them an opportunity to present their objections. In addition to complying with the requirements of

the Federal Constitution, state courts must also have authority under state law in order to exercise personal jurisdiction over a nonresident defendant(s); or any individual.

In other words, only legal and//or lawful jurisdictions; or American courts can render a decision. Jurisdiction over the person, property or matters before the court; must be established by PERSONAM JURISDICTION. 

Ex: The African-American [ Shaella Robinson ] woman from North Carolina was killed in Mexico. Probably by her devious friends; but because Mexico has no courts of justice; they do not have to go to Mexico; nor can Mexico extradite her to Mexico. Because Mexico has no jurisdiction, power, or authority over any American courts. If we had some type of foreign treaty with drug cartel nations; our jails and prisons would be filled with these Foreign Terrorist Organizations-FTO; but because the CIA, DEA, and other federal agencies want dark and dirty money from these terrorist organizations; our American citizens are targeted and not the criminals. 

Question; What is Personam Jurisdiction?

Answer: It is jurisdiction from a court and/or legal or lawful jurisdiction over people and property.

In accordance with the U.S. Constitution and state constitutions “PERSONAM JURISDICTION,” is a foundational principle of American jurisprudence. In essence, no court can render any decision affecting a person; or any U.S. citizen; unless personam jurisdiction has been established. Jurisdiction must be established over the person or property. Only legal and//or lawful jurisdictions; or American courts can render a decision. Jurisdiction over the person, property or matter before the court; must be established by PERSONAM JURISDICTION. These checks and balances are in place to protect American citizens from individuals pretending, or masquerading to be judicial officers; or sworn peace officers of the court.

IN PERSONAM JURISDICTION; Gives federal courts matters of federal statutes, laws, and federal organizations. Despite that the U.S. Supreme Court only hears a hundred cases a year; before the case; or judicial matter comes before the court; prerequisites must be met; such as is there a federal question; is this a matter of a Congressional passed law [ i.e., public laws ]

• In personam jurisdiction gives the court the power to render a decision; no court can render decisions on its own authority and power; it must have statutory, or established powers to render decisions. 

• When a person files a lawsuit that person is called a plaintiff, therefore, the plaintiff gives the court in personam jurisdiction over him, her or a property matter. 

• Then the court must establish and acquire jurisdiction over the defendant, by serving him; or her; or a business a copy of a plaintiff’s complaint and/or summons.

• The personal service personnel working for public and private corporations have no authority, power; or jurisdiction over any U.S. citizen. They are not LAW ENFORCEMENT PERSONNEL; THEY CANNOT PRETEND TO BE A LEO OR A OFFICER OF THE COURT-AT AT NO TIME. IF THEY DO LIE; OR DECEIVE A CITIZEN; IT IS FRAUD UPON THE COURT; AKA, A STATE OR FEDERAL CRIME; QUITE POSSIBLY CAN BE CONVICTED IN FEDERAL AND STATE COURTS FOR PRETENDING TO BE A OFFICER OF THE COURT; OR LAWFUL; OR LEGAL REPRESENTATIVE OF A LAW ENFORCEMENT ENTITY.

• COMPLAINT: The complaint or summons seeks relief usually in monetary concerns.

• PLAINTIFF: Party on whose behalf the complaint is filed.

• DEFENDANT: Party against whom an action is being brought against.

• SUMMONS: Order by a lawful or legal court before it at a certain time and place; but personam jurisdiction must also be established. 

Ex: A Mexican citizen and/or a dual or triple citizen has jurisdiction over American citizens at no time does a Mexican-have jurisdiction; or legal or lawful standing in any court; or jurisdiction in America.

• Sheriffs like Cook County Sheriffs are LEO of the county; personal service people are not LEOs and must never pretend to be LEO; or an official of the court. If the official is a representative of the court; the court provides documentation, or credentials by publication to validate that person’s PERSONAM JURISDICTION over serving a complaint or summons. Once certified mail [ free and clear of all fraud and fraud upon the court ] has been served to defendants; then the court can render a decision affecting his or her legal rights; even if the other party does not appear before the court. The defendant should appear before the court; but if the defendant is wise and prudent of proper jurisdictions; he or she can ignore fraud, fraud upon the court; and even unlawful judgments being rendered by bad or evil judges.

• PERSON SERVICE; OR SERVICE; Provides the defendant with a summons which is a copy of the complaint-that is it. No further actions are authorized; they are not authorized to trespass on public or private property without consent from the owners or tenants.

Must court powers or authority is limited to the borders in which it is located. If a different country or state is warranted; then PERSONAM JURISDICTION must be established in the state or country again. Again and always, the court must acquire PERSONAM JURISDICTION over a person or property over the defendant's name in the complaint or summons. 

In 2012, in the case of Chase Bank USA vs Fortunato- a district court judge refused the application of Chase Bank to authorize either an email or Facebook message as an alternative means of service on a third-party defendant who had used false information and addresses [ fraud & fraud upon the court ]; to secure multiple credit cards; and whom the bank was unable to locate physically. The federal district court said; “that the bank had not given the court” a degree of certainty about the defendant’s alleged Facebook profile and the email address attached to that profile to ensure the defendant was served; or received a notice by publication.

• This person was engaged in fraud and committed fraud upon the court, Chase bank, and its third party agents; these laws were made for the unlawful-not the law-abiding citizens. 

Under federal law and statute courts generally allow electronic service as an alternative in international cases. Fed R. Civ P. 4(f)(3), which governs all foreign transactions. The court said, if the defendant left the state, the complaint or summons has no jurisdictions; PERSONAM JURISDICTION is a jurisdiction where the person lives or resides; many states pass long-arm statutes, which a state may enable a person to be served or receive a complaint or summons because he or she is engaged in an employment relationship in a different state. 

LONG ARM STATUTE: A statute authorizing a state court to obtain jurisdiction; or PERSONAM JURISDICTION over an out-of-state defendant when that party has sufficient minimum contracts with the state. 

• One of the most important types of jurisdictions is SUBJECT MATTER JURISDICTION: Is the power of a court to render a decision in a particular type of case; or cases. 

County judges cannot render decisions over federal district courts cases, federal courts cannot render judgments on federal appellate cases; and appellate courts cannot render decisions on U.S. Supreme Court cases, and Supreme Court cannot render cases over military or court martial laws; unless a constitutional violation is at question. Each court has its own checks and balances; aka, subject matter jurisdictions. 

STATE JURISDICTIONS: The state court systems have subject matter jurisdiction over all cases not within their exclusive jurisdictions of the federal court systems. 

• In fact, all federal jurisdictions are called limited jurisdictions of power and authority; the FBI only has jurisdiction on federal laws listed in federal statute; if it works with local, county, or state court cases. The FBI joins in an MOU- Memorandum of Understanding PERSONAM JURISDICTION. So that it can use the state or county power or authority. The FEDS are really not that powerful as we think; in truth-county Sheriffs have the most police powers over people and/or proprietary-once PERSONAM JURISDICTION has been established. 

• In fact, when we say that state courts have jurisdiction, it is not just any state’s court system; but only the court system of the state whose law; or laws will be used to decide the case; or render a decision. 

• So, if in Illinois there is a breach of contract case arising out of a state court in Indiana, Indiana laws govern Indiana; and Illinois laws govern Illinois; or where the contract was made-that state laws would govern contract law; or state laws only-not federal; or any federal agencies. If any person or firm accepts federal money directly; or indirectly-that person; or firm falls under federal law; therefore, federal jurisdiction. 

• State Court Jurisdiction: all cases not under Exclusive Federal Jurisdiction.

• Only a few cases may be heard only in federal courts; such cases are within the EXCLUSIVE JURISDICTION of the federal court system. 

If a case was tried in Illinois or Cook County, Illinois are cases; ANY DECISION RENDERED BY THE JUDGE WOULD VOID. Why? The judge  or state court has no jurisdiction to render a decision?

• Cases that fall within the exclusive jurisdiction of the federal jurisdiction of federal courts include such matters as admiralty, bankruptcy, federal criminal prosecutions; and/or claims against the United States government; or it’s federal agencies.

• Most of the court rulings have to do with business firms and personnel who disobey the laws for greed, misappropriation of government funds for personal, private and non-governmental use. For example, funds allocated for veterans would be a federal case; or it could be a federal crime because veterans are considered a PROTECTIVE GROUP under federal and congressional mandated laws; such as members of Congress; certain Native Indian tribes, etc, etc and so forth. 

• EXCLUSIVE FEDERAL JURISDICTION:  Applies to cases that may be heard only in federal court systems. For example, the Merit System Review Board, MSRB has jurisdiction over federal employees employed in government service; but if a federal employee's rights and benefits are restricted and/or hindered. Federal employees can petition federal district courts, federal appellate courts; and the court of last resort, the US. Supreme Court. 

QUESTION: What is Exclusive authority or power: it is excluding or having power to or authority excluded. : limiting or limited to possession, control, or use by a single individual, individuals; or group; or groups.

EXCLUSIVE, adjective Having the power of preventing entrance; as exclusive bars.

According to Noah Webster; it is the “Debarring from participation; possessed and enjoyed to the exclusion of others; as an exclusive privilege.”
